This website is operated by Eos Seminars Ltd (referred to as "Eos Seminars"). As a user of this website (referred to as "you ") you acknowledge that any use of this website including any orders you place with Eos Seminars Ltd and any other transactions you make ("use/using") is subject to our terms and conditions below. (a) By using this website and / or Eos Seminars Ltd’s products and / or our services you agree to the terms and conditions set out here in these Terms and Conditions.

(b) We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website (see date at the top) and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.

(c) You agree that you have read and understood these terms and conditions and that you will continue to keep yourself informed of these terms and conditions.

(a) As stated above, this website is owned and run by Eos Seminars Ltd. On this website we refer to Ultra Hypnosis Ltd and it's range of audio hypnosis CDs and downloads, which were recorded by Kerin Webb, Gill Webb and Andrea Lindsay. Eos Seminars Ltd and Ultra Hypnosis Ltd are separate companies and not associated. Neither of these companies accepts any liability for the other company’s products, services or other actions. Using the products and / or services of any one of the above companies does not constitute any kind of customer / client connection with the other company.

3. Product Ordering

(a) Contract formation

(i) Your order to purchase a product from Eos Seminars Ltd is deemed to be an offer to purchase. Eos Seminars Ltd may accept or decline your offer. We will inform you if your offer to purchase has been declined.

(ii) Following the completion of your order process, we will send to you an order acknowledgement e-mail detailing the products you have ordered. Please note that this email is not an order confirmation or order acceptance.

(iii) Acceptance of your order and the completion of the contract between you and us will take place on despatch to you of the products ordered (the Goods) unless we have notified you that we do not accept your order or you have cancelled it (please see clause 3(c)(vi) below)

(b) Payment

(i) We take payment from your card when we receive your order, once we have checked your card details and stock availability. Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods.

(ii) The price you pay is the price displayed on this website at the time we receive your order apart from the following exception - whilst every effort is made to ensure that all prices on our website are accurate, errors may occur. We will inform you as soon as possible, if we discover an error in the price of goods you have ordered. In such a case, you will be given the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

(iii) Payment can be made by any method specified, including by credit card through PayPal and / or or by using PayPal's own payment transfer method or, if stated, by cheque. For information about the security of this website, please see the Privacy Policy below.

(iv) Title to any products you order through this website shall pass to you on delivery of the products provided that we have processed and received payment in full for the products.

(v) All prices include VAT (where applicable) at the applicable current rates but exclude delivery charges, unless expressly stated otherwise.

(c) Delivery

(i) We will only dispatch goods on confirmation that your payment has cleared.

(ii) When an order is accepted Eos Seminars Ltd will dispatch product(s) within 28 days of receipt of payment. If for any unlikely and currently unforeseen reason this is not possible we will inform you promptly and offer you the choice of an alternative product or a refund.

(iii) Orders are cross referenced with products sent for delivery, however, please verify that the product that is supplied is the same as the product you ordered.

(iv) All goods must be signed for by an adult aged 18 years or over on delivery.

(v) Risk of loss and damage of the Goods passes to you on the date when the Goods are delivered or on the date of first attempted delivery by us.

(vi) Under the Distance Selling Regulations, you have a right to cancel your order for any item purchased on this website for a full refund. This does not apply to any purchased CDs, if the seal on the packaging has been broken, nor to any downloaded products, if their electronic seal has been broken (the electronic seal will be deemed to have been broken when you have entered the download code that you will be sent by separate email after payment has been made which gives you access to the download, please note that on entering of the code you will lose your right to cancel the contract under the Distance Selling Regulations). To cancel, you can email us or write to us (see Contact page for details) within seven working days of delivery of your item(s), quoting your order number. If we have already taken payment from you, we will refund the full price of the goods to you. If the goods you had ordered have already been delivered to you, you must return the goods to us at your own cost or alternatively inform us when we can collect the goods from you, in which case we will charge the cost of such recovery to you. Whilst you are in possession of the goods, you must take reasonable care of the item(s) and must not use them.

4. Courses, Seminars and Workshops

(a) Enrolment on Courses, Seminars and Workshops and Order confirmation

(i) Completing an online and/or printed application form to enrol upon a course / seminar / workshop with Eos Seminars Ltd is deemed to be an offer to purchase. Eos Seminars Ltd may accept or decline your offer. We will inform you if your offer to purchase has been declined.

(ii) You confirm that you do not have a criminal record.

(iii) You confirm that you do not have reason to suspect that you currently have or may have depression/ clinical depression and / or other psychological illness.

(iv) Following the completion of your order process, we will send to you an order acknowledgement e-mail detailing the services you have ordered. Please note that this email is not an order confirmation or order acceptance.

(v) Acceptance of your order and the completion of the formation of a contract between you and Eos Seminars Ltd will take place on despatch to you of the order confirmation, unless Eos Seminars Ltd have notified you that we do not accept your order or you have cancelled your order prior to such confirmation.

(b) Payment of Courses, Seminars and Workshops

(i) We accept cash, cheques, credit/debit cards and PayPal. (For security reasons please DO NOT post cash payments to us.) If you choose to enrol by cash we can arrange for a mutually convenient time for you to meet with one of our representatives to submit a manually completed application form, which you can download from our website in advance, upon request, and complete in full in order for you to make your payment and to receive a receipt in person. If you choose to pay by cheque, you can post your payment to us after you have downloaded and manually completed a printed application form in full, to be returned to us in full with your cheque payment. If you choose to pay by credit/debit card we will take payment from your card when we receive your order, once we have checked your card details and after you have completed an online application form. If you choose to pay by PayPal we will take payment from your PayPal account when we receive your order, once we have checked your account details and after you have completed an online application form. In the event that we are unable to supply the service, we will inform you of this as soon as possible and a full refund will be given where you have already paid for the service.

(c) Course, Seminar and Workshop Cancellation

(i) If due to unforeseen circumstances any delegate needs to cancel an enrolment, up to one month before the course / seminar / workshop commences a refund of 66% of the paid course / seminar / workshop fee will be made by Eos Seminars L td (less a deposit which amounts to £150.00, or 50% of the fee if the programme is less than £150.00). Unfortunately, for any cancellations made within a month of the start date or after the start date of the course / seminar / workshop, no refunds are available.

(ii) If for any reason or due to unforeseen circumstances the programme you enrol upon has to be cancelled, Eos Seminars Ltd will refund your payment in full. Eos Seminars Ltd and/or its directors will not be liable for any other expenses.

(d) Conduct of courses, seminars and workshops

(i) Eos Seminars Ltd reserves the right to substitute the advertised trainers and include additional trainers and special guest trainers at any time.

(ii) Eos Seminars Ltd reserves its right from time to time to vary in its absolute discretion the course / seminar / workshop content and the material covered to that advertised, whilst ensuring that such content and materials will correspond with the overall requirements as advertised.

(iii) Eos Seminars Ltd reserves the right to deny, at their absolute discretion, without any prior notification and any reason being given, access to any individual or group of individuals, for the welfare of participants and organisers, and for the purpose of ensuring that the course / seminar / workshop runs smoothly, safely and in a manner which reflects the nature of the training, for all or part of the programme and / or registration.

(iv) If the need to deny you access arises you agree that full payment will be retained by Eos Seminars Ltd.

(v) Qualification (where applicable) is awarded upon successful completion of the course / seminar / workshop.

e) Information provided in our courses, seminars, talks and workshops may include theory, technique, personal experience, historical and anecdotal details, as well as broad principles. However, subject to Section 7(a) below: No information given in any training programme should be taken to mean that you are being advised to act or not act in any specific way by Eos Seminars Ltd, or by any of its employees. We expect you to assume responsibility for your actions and decisions both during and beyond any programme(s) you attend with us.

5. Therapy/Counselling/Coaching Services

a) All therapy/counselling/coaching services are provided by one or more trained practitioner(s), qualified in the service(s) being offered.

b) Subject to Section 7(a) below: No guarantees are offered or implied regarding the outcome and / or results of the service(s) provided.

c) Subject to Section 7(a) below: No information given in a therapy/counselling/coaching session should be taken to mean that you are being advised to act or not act in any specific way by Eos Seminars Ltd, or by any of its employees.

(d) By applying for a therapy/counselling/coaching service you confirm that you do not have a criminal record.

(e) By applying for a therapy/counselling/coaching service you confirm that you do not have reason to suspect that you currently have or may have depression / clinical depression and / or other psychological illness.

(f) Payment for therapy/counselling/coaching services

(i) We accept cash, cheques, credit/debit cards and PayPal. (For security reasons please DO NOT post cash payments to us.) If you choose to pay by cash or cheque you can pay in person when you arrive for your appointment, after you have completed a manual application form that will be provided. If you choose to pay by credit/debit card we will take payment from your card when we receive your order, once we have checked your card details and after you have completed an online application form. If you choose to pay by PayPal we will take payment from your PayPal account when we receive your order, once we have checked your account details and after you have completed an online application form. In the event that we are unable to supply the service, we will inform you of this as soon as possible and a full refund will be given where you have already paid for the service.

(ii) The price you pay is the price displayed on this website at the time we receive your order apart from the following exception - whilst every effort is made to ensure that all prices on our website are accurate, errors may occur. We will inform you as soon as possible, if we discover an error in the price of services you have ordered. (iv) All prices include VAT (where applicable) at the applicable current rates but exclude delivery charges (where applicable), unless expressly stated otherwise.

(v) Completing an application form to receive a therapy/counselling/coaching session with Eos Seminars Ltd is deemed to be an offer to purchase. Eos Seminars Ltd may accept or decline your offer. We will inform you if your offer to purchase has been declined.

(vi) Following the completion of your online order process, we will send to you an order acknowledgement e-mail detailing the services you have ordered. Please note that this email is not an order confirmation or order acceptance.

(vii) Acceptance of your order and the completion of the formation of a contract between you and Eos Seminars Ltd will take place on despatch to you of the order confirmation, unless Eos Seminars Ltd have notified you that we do not accept your order or you have cancelled your order prior to such confirmation.

(viii) When your online order is accepted we will send you an email offering you three appointment options for when the therapy/ counselling/coaching session may take place. You must reply by email to confirm your ability to receive a therapy/counselling/coaching session at one of the times offered. We will make every reasonable effort to provide the session at the agreed time. In the event that we are unable to supply the service, we will inform you of this as soon as possible and we will offer you the option of an alternative appointment or a full refund, where you have already paid for the service. If none of the three appointment time options we provide you with are suitable for you, we will provide you with a full refund, where you have already paid for the service. Please note: subject to Section 7(a), below: we reserve the right not to provide a therapy/counselling/coaching session or to stop a therapy/counselling/ coaching session at any point in the process without any reason needing to be given. If we choose to decline providing a therapy/ counselling/coaching session or to stop a therapy/counselling/coaching session before completion, if you have already made payment, a full refund will be given.

(g) Therapy/Counselling/Coaching Services Cancellation

(i) If any client needs to cancel an appointment, up to one week before the therapy/counselling/coaching session is due a refund of the paid fee will be made by Eos Seminars Ltd (less a deposit which amounts to £20). Unfortunately, for any cancellations made within a week of the date or after the date of the therapy/counselling/coaching session, no refunds are available.

(ii) If for any reason or due to unforeseen circumstances the therapy/counselling/coaching session you have applied for has to be cancelled, Eos Seminars Ltd will refund your payment in full. Eos Seminars Ltd and/or its directors will not be liable for any other expenses.

6. Psychic/Mediumship/Channelling Services

a) Please note: the survival of the soul and the possibility of spirit communication form a part of our religious beliefs.

b) Subject to Section 7(a) below: No guarantees are offered or implied regarding the accuracy, usefulness or otherwise of any information provided by way of attempted psychic/mediumship/channelling means.

c) All psychic/mediumship/channelling services should be considered to be for entertainment and informational purposes only and of an experimental nature.

d) Subject to Section 7(a) below: No information given in a psychic/mediumship/channelling reading should be taken to mean that you are being advised to act or not act in any specific way by Eos Seminars Ltd, or by any of its employees.

e) Payment of psychic/mediumship/channelling services (for readings which do not take place as part of a course / seminar / workshop).

(i) We accept credit/debit cards and PayPal for psychic/mediumship/channelling services. If you choose to pay by credit/debit card we will take payment from your card when we receive your order for a psychic/mediumship/channelling reading, once we have checked your card details and after you have completed an online application. If you choose to pay by PayPal we will take payment from your account when we receive your order for a psychic/mediumship/channelling reading, once we have checked your account details and after you have completed an online application.

(ii) The price you pay is the price displayed on this website at the time we receive your order, apart from the following exception - whilst every effort is made to ensure that all prices on our website are accurate, errors may occur. (viii) When your order is accepted we will send you an email offering you three appointment options for when the reading may take place. You must reply by email to confirm your ability to receive a psychic/mediumship/channelling reading at one of the times offered. We will make every reasonable effort to provide the reading at the agreed time. In the event that we are unable to supply the service, we will inform you of this as soon as possible and we will offer you the option of an alternative appointment or a full refund, where you have already paid for the service. If none of the three appointment time options we provide you with are suitable for you, we will provide you with a full refund, where you have already paid for the service. Please note: subject to Section 7(a), below: we reserve the right not to provide a psychic/mediumship/channelling reading or to stop a psychic/mediumship/channellingreading at any point in the process without any reason needing to be given. If we choose to decline providing a reading or to stop a reading before completion, if you have already made payment, a full refund will be given.

(f) All psychic/mediumship/channelling readings (other than those that take place during a course / seminar / workshop) are provided online through (1) the Skype internet communication service and / or (2) standard UK / USA phone numbers, provided by Skype. To receive your reading you will either need to phone one of the UK / USA phone numbers highlighted on our website (at your own cost) or provide your own access to Skype. At the time of writing (17/04/10) Skype advertise Skype to Skype calls as free. Please however check with Skype and your Internet Service Provider to ascertain what costs, if any, you may have to pay, for accessing the internet and / or using the Skype service.

7. Limitation of Liability

(a) Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.

(b) Subject to Section 7(a) above:

(i) Eos Seminars Ltd will use reasonable endeavours to verify the accuracy of any information on the site but makes no representation or warranty of any kind express or implied statutory or otherwise regarding the contents or availability of the site. Any indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under applicable law and subject to section 7(a) above.

(ii) Please note that information on these pages and on our products and in our services is not a substitute for qualified medical advice and does not replace the advice of your doctor. Therefore, if you think you have or may have a medical condition of any kind then you should seek the appropriate support and only use our products and services with the informed consent and guidance of your doctor (this is common good practice amongst all professional psychotherapists in which referral to a doctor often takes place in such circumstances). Information provided in our published books, printed manuals, websites, audio programmes, videos and podcasts does not constitute professional training in hypnosis, hypnotherapy, counselling, emotional freedom technique (EFT), thought field therapy (TFT), neuro linguistic programming (NLP), neuro affective desensitisation technique (NADT) coaching, psychotherapy or other form of therapy; business, personal, spiritual, psychic, or career advice.

(iv) Please note: all products, seminars and services provided by, and any information published by Eos Seminars Ltd in any form (including books, CDs, downloads, manuals, videos and podcasts) covering psychic, mediumship, channelling, psi, healing, past life regression, remote viewing, shamanism, prayer and related spiritual issues is for informational and / or entertainment purposes only and has not been experimentally proven.

(v) Some of our products and services utilise hypnosis / altered states of consciousness. Every product and / or service is presented by one or more trained, qualified and practising hypnotherapist(s). However, because altered states of awareness are involved we must obviously state that you should not use our products and/or services when driving, using machinery or doing anything which requires your attention.

(vi) Eos Seminars Ltd will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with these terms and conditions for any:

(vi).1 economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings); or

(vi).2 loss of goodwill or reputation; or

(vi).3 special or indirect losses

(vi).4 other losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.

(c) Notwithstanding the above, Eos Seminars Ltd’s aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to £1.00 or a sum equal to the amount paid or payable by you for the product(s) and/or services in respect of one incident or series of incidents attributable to the same clause, whichever is the greater.

(d) This clause 7 does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.

8. Virus disclaimer

(a) Reasonable steps have been taken to protect this Website by anti virus software but all visitors are advised to take all necessary steps to ensure that no virus contamination occurs. Subject to clause 7(a) above, no responsibility can be accepted by Eos Seminars Ltd for any loss or damage sustained as a consequence of any virus transmission

(b) Subject to clause 7(a) above, Eos Seminars Ltd cannot accept any liability for any loss of data or damage to your computer system (or any other computer system with which you may interact through your computer system and related peripheral components) which occurs due to your use of this website, our products or as a result of downloading material from this site.

(a) Any links to other websites and any references to other authors’ books/ products or services are provided for information only for smooth processing of your transaction. 10. Breach of these Conditions by You

If you breach any of these terms and conditions you agree to hold blameless Eos Seminars Ltd, its directors, those who deliver training for and on behalf of Eos Seminars Ltd, its subsidiary businesses, products and / or services. You agree to indemnify Eos Seminars Ltd, its directors, those who deliver training for and on behalf of Eos Seminars Ltd, its subsidiary businesses, products and / or services for all fees, legal fees and costs which may arise out of your breach of these terms and conditions.

11. General

(a) This agreement is subject to English law and jurisdiction.

(b) These Terms and Conditions represent the complete agreement between you and Eos Seminars Ltd and regulate all of your use of any and all of Eos Seminars Ltd’s goods and services (including, but not limited to, website(s), training courses, counselling, therapy, coaching sessions, psychic, mediumship, channelling services, articles, podcasts, videos, CDs, downloads and books) and these terms and conditions replace any previous agreements made between you and Eos Seminars Ltd.

(c) Please note that the headings used in these Terms and Conditions relating to each clause / element / section are used purely for ease and they do not have any contractual or legal effect of any kind.

(d) Eos Seminars Ltd reserves the right to transfer, assign, novate or sub-contract the benefit of the whole or part of any of its rights or obligations under these terms and conditions or any related contract to any third party. You may not assign your rights under these terms and conditions.

(e) If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected.

(f) No delay or failure by Eos Seminars Ltd to exercise any powers, rights or remedies under these terms and conditions will operate as a waiver of them nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing and signed by an authorised representative of Eos Seminars Ltd.

(g) You agree that in so far as permitted by law, any claim or cause of action, which you may make which arises because of your use of Eos Seminars Ltd products or services will be made (in such a way that it is filed to the appropriate courts of jurisdiction as set out in these terms and conditions) within one year of any claim or cause of action arising.
