This website is operated by Eos Seminars Ltd (referred to as "Eos Seminars"). As a user of this website (referred to as "you ") you acknowledge that any use of this website including any orders you place with Eos Seminars Ltd and any other transactions you make ("use/using") is subject to our terms and conditions below. Please:

1. General

(a) By using this website and / or Eos Seminars Ltd’s products and / or our services you agree to the terms and conditions set out here in these Terms and Conditions.

(b) We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website (see date at the top) and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.

(c) You agree that you have read and understood these terms and conditions and that you will continue to keep yourself informed of these terms and conditions.

2. Company Information

(a) As stated above, this website is owned and run by Eos Seminars Ltd. On this website we may sometimes refer to Ultra Hypnosis Ltd and it's range of audio hypnosis CDs and downloads, which were recorded by Kerin Webb, Gill Webb and Andrea Lindsay. Eos Seminars Ltd and Ultra Hypnosis Ltd are separate companies and not associated. Neither of these companies accepts any liability for the other company’s products, services or other actions. Using the products and / or services of any one of the above companies does not constitute any kind of customer / client connection with the other company.

3. Courses, Seminars and Workshops

(a) Enrolment on Courses, Seminars and Workshops and Order confirmation

(i) Completing an online and/or printed application form to enrol upon a course / seminar / workshop with Eos Seminars Ltd is deemed to be an offer to purchase. Eos Seminars Ltd may accept or decline your offer. We will inform you if your offer to purchase has been declined.

(ii) You confirm that you do not have a criminal record.

(iii) You confirm that you do not have reason to suspect that you currently have or may have depression/ clinical depression and / or other psychological illness.

(iv) Following the completion of your order process, we will send to you an order acknowledgement e-mail detailing the services you have ordered. Please note that this email is not an order confirmation or order acceptance.

(v) Acceptance of your order and the completion of the formation of a contract between you and Eos Seminars Ltd will take place on despatch to you of the order confirmation, unless Eos Seminars Ltd have notified you that we do not accept your order or you have cancelled your order prior to such confirmation.

(b) Payment of Courses, Seminars and Workshops

(i) We accept cash, cheques, credit/debit cards and PayPal. (For security reasons please DO NOT post cash payments to us.) If you choose to enrol by cash we can arrange for a mutually convenient time for you to meet with one of our representatives to make your payment and to receive a receipt in person. If you choose to pay by cheque, you can post your payment to us. If you choose to pay by credit/debit card we will take payment from your card when we receive your order, once we have checked your card details. If you choose to pay by PayPal we will take payment from your PayPal account when we receive your order, once we have checked your account details. (Please note: all payments made, including cash, cheque, credit, debit card must be accompanied by a completed online or printed application form.) In the event that we are unable to supply the service, we will inform you of this as soon as possible and a full refund will be given where you have already paid for the service.

(ii) The price you pay is the price displayed on this website at the time we receive your order apart from the following exception - whilst every effort is made to ensure that all prices on our website are accurate, errors may occur. We will inform you as soon as possible, if we discover an error in the price of services you have ordered. In such a case, you will be given the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the services, you will receive a full refund.

(iii) Payment can be made for courses, seminars and workshops by any method specified, either by card, by using the PayPal payment method or by cash or cheque. For information about the security of this website, please see the Privacy Policy below.

(iv) All prices include VAT (where applicable) at the applicable current rates but exclude delivery charges (where applicable), unless expressly stated otherwise.

(c) Course, Seminar and Workshop Cancellation

(i) If you need to cancel an enrolment, up to one month before the course / seminar / workshop commences a refund of 66% of the paid fee will be made by Eos Seminars L td (less a deposit which amounts to £150.00, or 50% of the fee if the programme is less than £150.00). Unfortunately, for any cancellations made within a month of the start date or after the start date no refunds are available.

(ii) If for any reason or due to unforeseen circumstances the programme you enrol upon has to be cancelled by Eos Seminars Ltd we will refund your payment in full, where payment has been made. Eos Seminars Ltd and/or its directors will not be liable for any other expenses.

(d) Conduct of courses, seminars and workshops

(i) Eos Seminars Ltd reserves the right to substitute the advertised trainers and include additional trainers and special guest trainers at any time.

(ii) Eos Seminars Ltd reserves its right from time to time to vary in its absolute discretion the content and the material covered to that advertised, whilst ensuring that such content and materials will correspond with the overall requirements as advertised.

(iii) Eos Seminars Ltd reserves the right to deny, at their absolute discretion, without any prior notification and any reason being given, access to any individual or group of individuals, for the welfare of participants and organisers, and for the purpose of ensuring that the programme runs smoothly, safely and in a manner which reflects the nature of the training, for all or part of the programme and / or registration.

(iv) If the need to deny you access arises you agree that full payment will be retained by Eos Seminars Ltd.

(v) Qualification (where applicable) is awarded upon successful completion of the course / seminar / workshop.

e) Information provided in our courses, seminars, talks and workshops may include theory, technique, personal experience, historical and anecdotal details, as well as broad principles. However, subject to Section 6(a) below: No information given in any training programme should be taken to mean that you are being advised to act or not act in any specific way by Eos Seminars Ltd, or by any of its employees. We expect you to assume responsibility for your actions and decisions both during and beyond any programme(s) you attend with us.

4. Personal Consultations

a) All therapy and coaching services (which can include, for example, hypnotherapy, counselling, neuro linguistic programming (NLP), thought field therapy (TFT), emotional freedom technique (EFT), neuro affective desensitisation technique (NADT), reiki, iridology, reflexology, massage, indian head massage, thai massage, aromatherapy, shiatsu, coaching, and any other form of therapy or coaching service that we may offer) are provided by one or more trained practitioner(s), qualified in the service(s) being offered and all psychic reading services (which can include mediumship, clairvoyance, channelling, remote viewing, precognition, past life reading and any other related form of psychic methodology that may be used) are provided by Kerin Webb who has attended mediumship and related psychic development training and who has demonstrated the apparent ability to provide others with relevant information that they have confirmed, to their satisfaction, was, in their opinion, received psychically by Kerin Webb (as per testimonials displayed on the website located at www.kerin-beautiful-day.co.uk).

b) Subject to Section 6(a) below: No guarantees are offered or implied regarding the outcome and / or results of the service(s) provided.

c) Subject to Section 6(a) below: No information given in a personal consultation should be taken to mean that you are being advised to act or not act in any specific way by Eos Seminars Ltd, or by any of its employees.

d) Please note: the survival of the soul and the possibility of spirit communication form a part of our religious beliefs.

e) Subject to Section 6(a) below: No guarantees are offered or implied regarding the accuracy, usefulness or otherwise of any information provided in a personal consultation.

f) All psychic reading services should be considered to be for entertainment and informational purposes only and of an experimental nature.

(g) Personal consultation services are provided (1) online through the Skype internet communication service and / or (2) through standard UK / USA phone numbers, provided by Skype, and/or ( 3) in person (at our venue). To receive your service you will need to phone one of the UK / USA phone numbers highlighted on our website (at your own cost) or provide your own access to Skype, or make your way to our venue. At the time of writing (13/04/11) Skype advertise Skype-to-Skype calls as free. Please however check with Skype and your Internet Service Provider to ascertain what costs, if any, you may have to pay, for accessing the internet and / or using the Skype service. (Please note: therapy and counselling services are only provided in person.)

(h) By applying for a personal consultation you confirm that you do not have a criminal record.

(j) Payment for personal consultations

(i) We accept cash, cheques, credit/debit cards and PayPal. (For security reasons please DO NOT post cash payments to us.) If you choose to pay by cash or cheque you can pay in person when you arrive for your appointment, after you have completed a manual application form that will be provided. If you choose to pay by credit/debit card we will take payment from your card when we receive your order, once we have checked your card details and after you have completed an online application form. If you choose to pay by PayPal we will take payment from your PayPal account when we receive your order, once we have checked your account details and after you have completed an online application form. In the event that we are unable to supply the service, we will inform you of this as soon as possible and a full refund will be given where you have already paid for the service.

(vi) Following the completion of your online order process, we will send to you an order acknowledgement e-mail detailing the services you have ordered. Please note that this email is not an order confirmation or order acceptance.

(vii) Acceptance of your order and the completion of the formation of a contract between you and Eos Seminars Ltd will take place on despatch to you of the order confirmation, unless Eos Seminars Ltd have notified you that we do not accept your order or you have cancelled your order prior to such confirmation.

(viii) When your online order is accepted we will send you an email offering you an appointment option for a personal consultation. You must reply by email to confirm your ability to receive a session at the time offered. We will make every reasonable effort to provide the session at the agreed time. In the event that we are unable to supply the service, we will inform you of this as soon as possible and we will offer you the option of an alternative appointment or a full refund, where you have already paid for the service. If the appointment time option we offer you is not suitable for you we will seek to arrange an alternative appointment with you, however, where this is not possible we will provide you with a full refund, where you have already paid for the service. Please note: subject to Section 6(a), below: we reserve the right not to provide a session or to stop a session at any point in the process without any reason needing to be given. If we choose to decline providing a session or to stop a session before completion, if you have already made payment, a full refund will be given.

(k) Personal Consultation Services Cancellation

(i) If you need to cancel a personal consultation, up to one week before the session is due, where payment has been made, a refund of the paid fee will be made by Eos Seminars Ltd (less a deposit which amounts to £20). Unfortunately, for any cancellations made within a week of the date or after the date of the session, no refunds are available.

(ii) If for any reason or due to unforeseen circumstances the personal consultation you have applied for has to be cancelled by Eos Seminars Ltd we will refund your payment in full, where you have already paid for the service. Eos Seminars Ltd and/or its directors will not be liable for any other expenses.

5. The Society of Mediums and Psychics

1) The Society of Mediums and Psychics is owned by Eos Seminars Ltd.  Membership of The Society of Mediums and Psychics does not mean or imply that you are also a member of Eos Seminars Ltd in anyway, including but not limited to, not being a director and/or not being an employee and/or not being a sub contractor.

2) If you become a member of The Society of Mediums and Psychics, because you are not a member or employee of Eos Seminars Ltd you will not therefore have any voting rights or influence in the business of Eos Seminars Ltd.

3) The Society of Mediums and Psychics seeks to provide the opportunity for its members to interact with each other and / or with the public through our dedicated website located at www.societyofmediumsandpsychics.com and / or through our related social network.  While we will make reasonable effort to ensure that our Society of Mediums and Psychics website and social network will be available and in good working order, no guarantees are offered or implied. We reserve the right to permanently or temporarily remove the website and / or social network from service at any time, should the need arise. You must provide you own means to access the website, at your own cost.

4) The Society of Mediums and Psychics website will also aim to provide the means for each member to display content, including but not limited to, some text and a photo of and about themselves in order to to promote themselves for business and / or for social reasons.  Each member is responsible for providing the content to be displayed.  (You must have copyright permission to use the material submitted.) Please be aware, if you provide contact details for public display, society members and members of the public will be able to make contact with you using this information.  As a member you are also invited to submit articles about mediumship, psychic ability and related subjects for inclusion on The Society's website. Eos Seminars Ltd may decline to post any or all of the content (text, photos, articles, etc) you supply and / or edit and / or remove any content (text, photos, articles, etc) already displayed, as we see fit. By submitting content (including, but not limited to text, photos and articles) you grant Eos Seminars Ltd a non-exclusive, worldwide, royalty free, sub-licensable, transferable, right to use any content you post. This license will exist as long as you maintain an active account on The Society of Mediums and Psychics website and/or social network and/or display content on the website and/or social network.  When you delete any content the license will expire, except where you have allowed others to use the content on our website and/or social network and/or or where they have shared it and it remains active and undeleted by them. (Content that you delete may remain stored on our servers in backup copies but it will not be available to the public.)

5) By using the Society's website and / or social network you acknowledge, (a) that you are responsible for all activity that takes place on your account, (b) that will protect your password and not share it with others, (c) that you will not stalk, harass, seek to offend or behave in any illegal manner towards other users and/or Eos Seminars Ltd and/or its employees, (d) that you will not seek to disrupt the service(s) of the website and/or social network in any way, (e) that you will not post illegal, malicious, pornographic, or hate based material to The Society of Mediums and Psychics website or social network, (f) that you will not circulate viruses or other malicious computer code through the website and/or social network, (g) that you understand that by using our website and/or social network you may be exposed to illegal, malicious, pornographic, hate based and other material that may be offensive to you, (h) that you should use appropriate virus guard when using the Society of Mediums and Psychics website and / or social network, (i) that you acknowledge that you use the website and / or social network at your at your own risk, (j) and that subject to section 6(a) below, Eos Seminars Ltd disclaims any liability with regard to your use of The Society of Mediums and Psychics website and / or social network.

6) Membership of The Society of Mediums and Psychics is conditional upon a) membership dues being paid and up to date (except where an introductory offer of free membership has been made available), b) adherence to the Society's Code of Conduct, which, also forms a part of these terms and conditions where membership of The Society is applicable, c) the discretion of the directors of Eos Seminars Ltd.  If it becomes necessary to terminate your membership you will be informed of this and we will cease to collect your membership dues from the next dues payment date.

7) Payment for Membership.  (a) The cost of membership of The Society of Mediums and Psychics is displayed on our website at www.societyofmediumsandpsychics.com .  Whilst we seek to provide correct information, mistakes can happen.  If an error is made regarding the advertised and/or charged membership fees, when we become aware of the error you will be offered the chance to reconfirm your application and/or membership at the correct price, or a refund, where you have already paid for the services. If for any reason we are not able to supply the membership service to you at the point of application, you will be offered a refund, where payment has been made.

If we choose to decline providing membership or to cancel your membership we will either (i) refund membership fees if they have been paid as a part of a new application, or (ii) cease to collect further membership fees if your membership is cancelled after your initial fee payment has been made. Eos Seminars Ltd and / or its directors will not be liable for any other expenses.

(8) (a)The Society of Mediums and Psychics does not provide psychic reading services or training programmes.  The Society exists, in part, to enable members to promote their services to other members and / or to the public.  However, all arrangments for psychic readings, training and any related psychic services or services of other kinds are made between the service provider and the service user.  Subject to Section 6(a), below, Eos Seminars Ltd disclaims any liability whatsoever to the fullest extent of the law for any service or services provided by any member to any other member and/or members and /or to any member of the public.  If you use the services of a member of The Society of Mediums and Psychics therefore, be aware that you are entering into a direct relationship with that service provider and not with Eos Seminars Ltd / The Society of Mediums and Psychics.

b) Subject to Section 6(a) below: No guarantees are offered or implied regarding the outcome and / or results of any service(s) offered by Eos Seminars Ltd / The Society of Mediums and Psychics.

c) Subject to Section 6(a) below: No information provided by Eos Seminars Ltd or displayed on the Society of Mediums and Psychics website or social network forum (or through any communication services that may be provided through the website and/or social network) should be taken to mean that you are being advised to act or not act in any specific way by Eos Seminars Ltd, or by any of its employees, or by any member of the Society of Mediums and Psychics. 9) Eos Seminars Ltd does not necessarily endorse the views of the members of The Society of Mediums and Psychics.  Contact details (including, but not limited to email addresses, website links, phone numbers, Skype, or postal addresses) provided through the Society of Mediums and Psychics website and/or social network to any member or organisation should not be taken as an endorsement of that member / organisation by Eos Seminars Ltd, or as a recommendation by Eos Seminars Ltd to make contact with any member / organisation or to use any services that any member / organisation may offer to provide.

6. Limitation of Liability

(a) Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.

(b) Subject to Section 6(a) above:

(i) Eos Seminars Ltd will use reasonable endeavours to verify the accuracy of any information on the site but makes no representation or warranty of any kind express or implied statutory or otherwise regarding the contents or availability of the site. Any indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under applicable law and subject to section 6(a) above.

(v) Some of our products and services utilise hypnosis / altered states of consciousness. Every such product and / or service is presented by one or more trained, qualified and practising hypnotherapist(s). However, because altered states of awareness are involved we must obviously state that you should not use these products and/or services when driving, using machinery or doing anything which requires your attention.

(vi) Eos Seminars Ltd will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with these terms and conditions for any:

(vi).1 economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings); or

(vi).2 loss of goodwill or reputation; or

(vi).3 special or indirect losses

(vi).4 other losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.

(c) Notwithstanding the above, Eos Seminars Ltd’s aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to £1.00 or a sum equal to the amount paid or payable by you for the product(s) and/or services in respect of one incident or series of incidents attributable to the same clause, whichever is the greater.

(d) This clause 6 does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.

7. Virus disclaimer

(a) Reasonable steps have been taken to protect this Website by anti virus software but all visitors are advised to take all necessary steps to ensure that no virus contamination occurs. Subject to clause 6(a) above, no responsibility can be accepted by Eos Seminars Ltd for any loss or damage sustained as a consequence of any virus transmission.

(b) Subject to clause 6(a) above, Eos Seminars Ltd cannot accept any liability for any loss of data or damage to your computer system (or any other computer system with which you may interact through your computer system and related peripheral components) which occurs due to your use of this website, our products or as a result of downloading material from this site.

If you breach any of these terms and conditions you agree to hold blameless Eos Seminars Ltd, its directors, those who deliver training for and on behalf of Eos Seminars Ltd, its subsidiary businesses, products and / or services. You agree to indemnify Eos Seminars Ltd, its directors, those who deliver training for and on behalf of Eos Seminars Ltd, its subsidiary businesses, products and / or services for all fees, legal fees and costs which may arise out of your breach of these terms and conditions.

(a) This agreement is subject to English law and jurisdiction.

(b) These Terms and Conditions represent the complete agreement between you and Eos Seminars Ltd and regulate all of your use of any and all of Eos Seminars Ltd’s products and services and these terms and conditions replace any previously made between you and Eos Seminars Ltd.

(c) Please note that the headings used in these Terms and Conditions to indicate each section are used purely for ease and they do not have any contractual or legal effect of any kind.

(d) Eos Seminars Ltd reserves the right to transfer, assign, novate or sub-contract the benefit of the whole or part of any of its rights or obligations under these terms and conditions or any related contract to any third party. You may not assign your rights under these terms and conditions.

(e) If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected.

(f) No delay or failure by Eos Seminars Ltd to exercise any powers, rights or remedies under these terms and conditions will operate as a waiver of them nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing and signed by an authorised representative of Eos Seminars Ltd.

(g) You agree that in so far as permitted by law, any claim or cause of action, which you may make which arises because of your use of Eos Seminars Ltd products or services will be made (in such a way that it is filed to the appropriate courts of jurisdiction as set out in these terms and conditions) within one year of any claim or cause of action arising.

PRIVACY POLICY

(iii) WuFoo, which is a company we sometimes use to provide online forms that applicants can use to apply for courses, workshops, personal consultations and other services - for information about WuFoo (http://wufoo.com/) and their security measures, please refer to their website (please note: Wufoo DOES NOT gather or hold your credit/debit card details, only PayPal does this),

(iv) any of our professional advisors where necessary; and/ or

(v) if required by law and / or for legal reasons; and/or

(vi) if we sell some or all of our company, then the data we have collected that is associated to our company, or any part of the company that has been sold (such as, for example, Best Buddy Books, or The Society of Mediums and Psychics) will be acquired by the new owner(s) in order that the transfer of the newly acquired business can proceed smoothly and in good working order.

5. Storage and processing of confidential financial information (which includes credit card and payment details) ("Confidential Financial Information")

When payment is made on-line, such payment is made directly to PayPal. We will not at any time hold any of your Confidential Financial Information. For security measures of PayPal, please refer to their website.
